国家司法考试背景下民法学本科教育的困境与出路

摘　　要：2002年以来,国家司法考试制度的实行对我国法学本科教育产生了强烈的冲击和深远的影响。民法学作为全国高等院校法学专业的核心课程之一,在法学本科教育和司法考试中,具有举足轻重的地位,集中体现了法学本科教育与司法考试的冲突与契合。我们要理性看待司法考试对民法学本科教育的负面影响,正确确立民法学本科教育的目标,通过改革教学方法、创新教学手段,使民法学的本科教育尽快脱离困境,实现民法学本科教育与司法考试的良性互动和协调发展。Since 2002, Chinese Law -education during undergraduate course has been impacted intensely and influenced profoundly by implementing the system of Chinese Justice Examination. As one of the center - courses in colleges and universities in China, the Science of Civil Law, which concentratedly reflects the conflict and the correspondence between Jurisprudence education and Chinese Justice Examination, occupies the most significant position, both in Jurisprudence education and in Chinese Justice Examination. Therefore, we have to treat the negative influence rationally, which is from Chinese Justice Examination to the Science of Civil Law education. In addition, we must establish the correct target of the Science of Civil Law education; prompt the Science of Civil Law education to be off the hook via the reformation and the innovation of educational method, in order to realize the harmonious co - development between the Science of Civil Law education and Chinese Justice Examination.
