摘　　要：刑法中的义务冲突要求存在多个义务,多个义务中被侵害的法律义务局限于刑事义务,但被履行的义务可以包括刑事义务之外的其他法律义务以及重大的道德义务。义务冲突不同于被胁迫行为之处,主要在于义务冲突困境中行为人不能全部履行担负的义务,而被胁迫行为则是对行为人自由意志的干涉;行为人选择不作为的后果、冲突的内容、紧急状态的形成原因则是紧急避险有别于义务冲突之处;正当防卫是行为人的一项权利,而义务冲突中行为人始终面临履行哪一个义务。The conflict of obligations is considered within the scope of the criminal law.The legal obligations infringed upon are confined to criminal obligations while the legal obligations fulfilled may include obligations other than criminal obligations,and the obligations fulfilled may be moral obligations.Given the fact that some lawful interests are no longer regarded as important in the social life and some other important interests are still not yet protected by the law,legal obligations may not be a person＇s first choice when they conflict with moral obligations.Therefore,the criminal law is not concerned about the conflict of obligations itself,but the person＇s fulfillment of obligations in this dilemma of conflicting obligations.
