摘  要:高校毕业生就业歧视现象不仅影响高等教育的走向和发展、造成劳动力资源的不合理配置、影响社会的和谐安定,而且也是对法治精神和法律价值的背离。立法保障是真正实现毕业生就业平等的重要手段,因此应从立法角度出发,针对我国反就业歧视立法主体意识薄弱、法律层次体系不规范、反就业歧视法律缺失的现状,试图通过增强立法主体意识、规范反就业歧视法律体系、制定高校毕业生的反就业歧视法三方面对就业歧视现象进行法律规制。Discrimination in employment of college graduates affects not only the direction and development of higher education, which results in the unreasonable allocation of labor resources, but also social harmony and stability. It is also a departure from the law spirits and the legal value. Legislative protection is an important means to realize equality in employment. Therefore, this article, from a legislative perspective, discusses regulating the phenomenon of employment discrimination by enhancing the awareness of legislative subjects, regulating the legal system against employment discrimination and drafting law against employment discrimination in response to the lack of consciousness of legislative subjects, non- standard legal level system and the imperfect legal system against employment discrimination.
