摘　　要：构建合理有效的公立高校管理机制一直是我国高等教育改革的重点之一。教育信托是公立高校管理方式的一种创新。从性质上看,教育信托属于一种公益信托。教育信托制度有利于避免政府的不当行政干预,保障公立高校的办学自主权;有利于提高公立高校的教育质量和办学效益;有利于防止公立高校国有资产的流失。构建我国的教育信托制度时,可由全国人大教科文卫委员会担任教育信托的管理机构,由教育行政主管部门担任教育信托的监察人,并对公立高校的权利与义务、受教育者的权利等问题加以规定。Constructing a relational and effective management mechanism of public universities is always one of central rhetorical questions of Chinese higher education.Education trust is an innovative method of public university management.The nature of education trust is a type of charitable trusts.The system of education trust is beneficial to avoiding improper administrative intervention of government,safeguarding the autonomy of public universities,enhancing education quality and operating efficiency,and preventing the loss of state-owned assets in public universities.In China,the managing organization of education trust should be the Education,Science,Culture and Health Committee of the National People＇s Congress,and the supervisor of education trust should be the administrative department of education.Other issues such as the rights and obligations of public universities and the rights of educatees should be regulated.
