摘　　要：针对《侵权责任法》和《医疗事故处理条例》有关举证责任不同之处的分析,明确医疗医构应尽的义务和病案室在管理工作中有关患者隐私权和知情权方面存在的薄弱环节,探讨规范病案查阅和复印工作的措施。只有加强病案室的细节建设,尽到义务,才能更好地保证医疗安全,以适应新出台的《侵权责任法》。To analyze the differences of burden of proof between ‘ Tort Liability Law＇ and ‘ Medical Malpractice Management Regulation＇. To understand obligations of medical institutions and weak link of right of privacy and right to know in medical record management. To discuss measures which can standard Medical record consult and copy. We should only strengthen details construction, fulfill the obligations to ensure medical safety, and to adapt to the new law of ‘Tort Liability Law ＇.
