预告登记制度探析

摘　　要：《物权法》首次确立的预告登记制度,预告登记是指确保将来的债权能够实现,保障将来取得物权等目的,按照约定向登记机构申请办理预先登记。文章认为,预告登记与预售登记并不相同,预告登记依双方当事人的约定,将所保全的债权请求权登记于登记簿上,以产生物权排他效力。同时预告登记具有权利保全,顺位保全以及破产保全三大效力。其效力具有暂时性、附随性以及保障物权请求权的实现的特征。由于本登记、权利人怠于行使权利以及债权消灭等原因,预告登记的效力将终止。Property Law was first established in the notice of registration system,the notice of registration is to ensure the realization of creditor protection in the future to achieve the purpose of property rights,etc.,in accordance with the contract to the registration agency to apply for pre-registration.Notice of registration is different from the pre-sale registration,notice of registration in accordance with the conventions of both parties,the preservation of claims claim registered in the register,in order to generate property rights exclusionary effect.Notice of registration has the right to preserve the overall preservation and preservation of the three effective bankruptcy.Its effect is temporary,incidental and protection of property rights claims to achieve the characteristics.Due to the registration rights to lazy to exercise their rights and the eradication of debt and other reasons,the notice of registration will be eliminated.
