关于安康民事案件执行情况的调查与思考

摘　　要：民事案件执行难是一个长期存在的问题。在对安康基层法院2008-2010年民事案件执行情况调研后认为,安康民事案件执行立案和案件执结率逐年上升,执行状况良好。为进一步提升民事案件执行力,根据安康经济社会文化发展状况和地理状况,安康的民事执行除采用多种强制方式外,应加强执行和解与劳务代替债务的执行方式。这样既有利于当事人关系恢复,也有利于社会和谐稳定。The difficulty in enforcement in civil cases exists for a long time. The research on the implementation of civil cases in Ankang city in the year 2008--2010 for proves that the rate of case filing and case ruling has increased year by year and the implementation has been in good condition. To further enhance the execution of civil cases, according to the economic, social and cultural development and geographical conditions, in addition to a variety of mandatory approach, the civilian implementation should strengthen the implementation of the enforcement of a settlement with labor instead of debt, which helps restore the client relationship and promote social harmony and stability
