回避制度之改良与保全机制之完善——以《民事诉讼法》修改为背景的思考

摘　　要：《民诉法修改决定》的通过,使我国现行《民事诉讼法》得到了较为全面的改良与完善。具体就回避制度而言,除在回避事由等方面明显更趋周密外,没有适时借鉴、吸收"依职权裁定回避"之适宜方式,显为此次修法之不足;就保全机制的完善来讲,"财产保全"概念之弃用与"保全"用语之"上位",显然使得与财产保全平行之"行为保全"有了容身之所,但从财产保全与行为保全共同之目的,以及二者与证据保全之逻辑关系来看,似以"执行保全"来指代财产保全和行为保全更加合理。The new amendments to the civil procedure law made our present civil procedure law comprehensively improved and perfected.As to the challenge system,though more causes concerning challenge are more thorough than before,the appropriate mode of declaring challenge in accordance with the court＇s authority is not absorbed.As far as the improvement of the preservation system is concerned,the abandonment of property preservation concept and the term ＂challenge＂ taken as a superior term,which obviously makes property preservation paralleling to behavior preservation had a shelter,but from the common goal of the two types of preservation,as well as their logical relationship with evidence preservation,executive preservation will be more reasonably refer to the two types of preservation.
