摘 要:劳动法是以劳动者权利为中轴建立的法权体系,劳动者权利概念是劳动法学的核心概念。现有研究资源囿于方法论的局限,进展不尽如人意。构建内部和谐与外部稳定的劳动者权利的概念体系应遵循法律类型化的思维步骤,勾勒出作为"规定功能法概念"的劳动者权利之于劳动法律制度体系化功能的意义脉络。它必须清楚地表达原则与规范之间的关联方式。将类型化的劳动者权利的主导形象通过权利的"元形式"结构表达其规范意义,使原则与制度之间错落有致地搭配,从而将劳动法秩序的基本思想贯穿到劳动者权利规范体系的最深处,形成外部稳定的权利体系。Labor law is the legal system to establish the rights of workers. The laborers' rights concept is the core concept of labor law. Existing research resources have been limited by methodology so that the progress is not much. Construction of internal harmony and external stability of laborer' s rights concept system should fol- low the legal types of thinking process, making the outline of the laborer' s rights in the legal system as "provi- sions of function concepts". It must clearly express the principles and norms of the association between the modes. The dominant image of a type of workers' rights should express its normative meaning through fight "element" structure to make the principle and the system well proportioned, so that the labor law order and basic idea can be carried deeply into workers' rights norms system, forming an external stable fight system.
