摘 要:受义务教育权首先是一种应然的权利集合,宏观表现为平等权和免费权两种权利,平等权又包括平等就学权、教育条件平等权、教育效果平等权三项内涵。从实然权利的角度来看,受义务教育权由于受到社会分层的影响,其应然权利束的实现受到了不同程度的限制。由此造成的不平等,应当通过相应的法律对策来加以解决,具体包括:通过制定《义务教育投入法》,明确并落实各级政府义务教育经费分担机制,以充分保障免费权、教育条件平等权的实现;通过松绑户籍制度,合理配置义务教育资源,在财税法上建立公平、规范的义务教育补偿制度和财政转移支付制度,以充分保障平等就学权、教育效果平等权的实现;通过建立完善的受义务教育权行政救济机制并确立义务教育公益诉讼制度,以全面救济受义务教育权主体。Compulsory education rights firstly refer to rights as they ought to be, which include the right of equality and the right of free education. The right of equality is contained of equal educational opportunities, equal conditions of education, equal results of education, etc. From the point of view of rights as they are, compulsory education rights are influenced by social stratification so that its rights as they ought to be are limited at different levels. The resulting inequality should be resolved through the appropriate legal countermeasures that are the enactment of Compulsory Education Investment Act,the im- plementation of sharing mechanism of compulsory education in all levels of government, the relaxation of the household regis- tration system, the rational allocation of compulsory education resources, the establishment of compensation system and fiSCal transfer payment system of compulsory education in tax law, the improvement of administrative relief mechanism of compulsory education rights and the establishment of nublic interest litigation system of compulsory education, etc.
