摘 要:在一系列紧凑的房地产市场宏观调控新政之下,一些商品房买卖合同无法实际履行或者履行之后又起纷争。开发商、业主和政府该何去何从,不少人选择运用"情势变更"来维护自己的利益。那么,在现实中该原则是否能适用于商品房买卖合同,在什么情况下适用,会产生何种后果,文章欲从这些方面作出分析,为房地产交易市场的稳定寻求解决途径。A considerable amount of sales contracts for commercial housing are,under serials of new policies on macro-control of real estate, in a status of being unable to be performed, or causing disputes even if they were performed.What would the developers,owners and government do?It seems a good way to protect one's interests by using the doctrine of "changed circumstances'.Then it will be asked whether and when it can be applied to a contract for commercial housing and what the effect of such application.The paper dwells on these problems and tries to find a way to stabilize the real estate market.
