摘 要:在社会转型时期学校师生冲突中,教师权利受到了严重的侵犯,其主要根源是教育立法质量不高,教育法律体系不完善;教师本身履行义务不认真导致自身合法权利受侵害;学生权利的非理性聚合;社会对师生关系中教师监督的部分失真。因此,有必要在法律层面上研究师生关系的应然状态,保障教师在教学工作学习中的正当权利,特别是赋予教师的惩戒权,这是学校学习教学能够健康持续发展的一个重要保证。In the period of social transformation, the teachers" rights have been violated in the conflict between teachers and students, the main source of which is the low quality of educational legislation, the imperfect of education law system,the unconscientiously perform of their duties; the irrational polymerization of students rights and the partial distortion of teachers" supervise in the teacher-student relationship. Therefore, it is necessary to study the relationship between teachers and students in the legal level to protect the legitimate rights in the teaching learning of teachers, especially to give teachers the punishment power, this is an important guarantee to the healthy and sustainable development of school teaching.
