摘  要:自商鞅變法至秦始皇統一六國,法家一直是秦的官學。秦亡,漢襲秦制。經漢武帝"罷黜百家,獨尊儒術",法家思想遂湮没不彰,而法家建立的中央集權制、私田制和法制,則一直沿革至清。本文從法家思想始于子產、法家的人性論與"以刑去刑"、"尊主卑臣"的民本思想等幾個角度,對法家思想進行了探討。From Shang Yang Reform to the unification of six other states by Qin Shi Huang,legalism remained to be the official ideology of the Qin State.After the downfall of Qin,its systems were still followed by the Han Dynasty.Since Emperor Wu of Han adopted Confucianism as the state philosophy,the thinking of legalism went on decline down to oblivion.Even so,the centralized state structure,private field system and rule of law remained in effect until the Qing Dynasty.My article dwells on Zichan's thinking as the fountain head of legalist thinking,investigates the views of legalists on human nature and other humanistic tenets such as 'to abolish the punishments by heavy penalty,' and 'to pay due respect to someone according to his hierarchy.'
