大学社会责任的本原性质、履约机理与治理要义

摘　　要：大学本质上是融"学术性"与"契约性"为一体的契约联合网络,大学、市场和社会三者之间是"异质共生与互补"的关系,大学社会责任的逻辑起点在于基于交换关系所衍生的"契约性"与"学术性",其本原性质可表述为基于"学术性"的契约之履行过程。大学社会责任可以分为学术责任、育人责任、政治责任、法律责任与伦理责任,大学社会责任的价值根源在于大学自治与学术自由,大学社会责任履行可通过"学术力量主动"、"市场力量推动"与"社会力量引导"来予以实现。据此,可以构建包含价值根源、实现路径、责任与契约类型等在内的大学社会责任的履约机理模型。大学社会责任的履行要有一个"边界",其治理要义在于"有限度承担"而非"过度活跃"。Essentially speaking, the nature of universities is characteristic of the contract-based network integrating the academic property with the contractual property. The relationship among university, market and society demonstrates their differences in nature but co-existing and being complementary to each other. Logically, the start point of the social responsibilities of universities （SRU） results from the academic property and contractual property, which both grow from the exchange relationship between the different parties. Therefore, the essential property of the SRU can be understood as the contract implementation process guided by and based on ＂the academic property＂. The SRU includes the responsibilities in academy, educating talents, politics, law and ethics, which are all rooted in the self-governance and academic freedom of universities. The realization of these responsibilities can depend upon the driving of academic force, the push of market force, and the guidance of social force. Accordingly, the model of fulfilling-contract mechanism of the SRU can be constructed, which is made up of the roots of value, the realizing paths, responsibilities, and types of contracts. Also, it is supposed to have a clear ＂boundary＂ of the SRU. The governing gist of the SRU lies in ＂the legitimate accountability＂ instead of ＂the over-undertaking＂.
