摘 要:劳务派遣用工因其具有优化人才结构、便捷人事管理、降低人工成本等竞争优势,得到众多国有企业的"青睐",但就我国目前劳务市场的用工情况来看,劳务派遣用工模式存在滥用的现象,在损害劳动者合法权益的同时,用工企业本身也面临诸多法律风险。试从劳务派遣用工现状出发,以最新出台的《劳务派遣暂行规定》为背景,结合当前劳务派遣用工市场呈现的不依法签订劳动合同、派遣机构不规范、劳务派遣用工主流化及同工不同酬等突出问题,从用工企业防范法律风险的视角入手,深入剖析可能潜藏于劳务派遣用工企业的主要法律风险,并就雇主责任、选用合作机构、岗位定位不当同工不同酬等风险的主要表现形式和法律不利后果进行分析,提出可采取的有效防范措施,以应对当前立法变革。Labor dispatch is favored by many state-owned enterprises due to its competitive advantages such as talent structure optimization, convenient personnel management, and labor cost reduction. However, from the angle of the current employment in the labor market in China, abuse of the labor dispatch pattern exists: the legitimate rights and interests of workers are harmed, and the employers themselves also face many legal risks. This paper introduces the current status of labor dispatch, the latest Interim Provisions on Labor Dispatch as the background, and the outstanding problems in the current labor dispatch market such as not signing labor contracts according to law, labor dispatch institutions not standardized, labor dispatch becoming a mainstream, and unequal pay for equal work. From the perspective of risk prevention for employers who take dispatch workers, this paper makes an in-depth analysis of the main potential legal risks of the employers. The paper analyses the main forms of the risks such as the employers' responsibilities, selection of partner institutions, unequal pay for equal work due to improper job positioning and their adverse legal consequences, and puts forward effective countermeasures to deal with the current legislative change.
