摘　　要：论文结合具体事例,从学生及家长法律意识的提高、教育法律法规不够完善、学校教育行政行为的不当等角度,对导致高职院校教育行政诉讼发生的主要原因进行剖析。从如何完善教育法律法规、提高学校依法行政的意识、建立诉前解决纠纷的机制协商息讼等角度提出了减少教育行政诉讼的方法与对策,并就如何应对教育行政诉讼提出一些建议。Combining with concrete examples, the main reasons of the educational administrative litigation in higher vocational colleges was analyzed in the paper,from improving the students＂ and parents＂ awareness of the law,the education laws and regulations are still not perfect, school education administrative misconduct and so on. And the method and countermeasures how to reduce the educational administrative litigation was provided by improving the educational laws and regulations, improving the awareness of administration according to law, set up the mechanism of resolve disputes to negotiation lawsuit before litigation and so on. And some recommendations on how to respond to the educational administration litigation was provided at the same time.
