民办学校分类管理改革的关键:合理处置举办者产权

摘　　要：改革开放以来,我国民办学校举办者积极投资办学的根本目的是赢得预期的市场利益。现有民办学校举办者产权不明、权责利失衡等财产关系问题,是制约营利性与非营利性分类管理改革的根本性障碍。基于民办教育的历史与现实考虑,要实现民办学校平稳地向营利性与非营利性转型分流,关键是依法保护举办者的财产权益。在分类管理制度实施中,政府应客观公平地处理民办学校存量产权关系,善待举办者应有的财产利益,建立适当的财产保值增值激励,完善产权运行保障机制,以保护举办者的办学积极性。Since the reform and opening up,the fundamental purpose of the organizers in non-governmental education institutions is to win the expected market benefits.The problem of property relation such as unclear property rights of non-governmental education institutions and the imbalance between power and responsibility is the fundamental obstacle to the reform of for-profit and non-profit classification management.Based on the historical and practical considerations of non-governmental education,it is necessary to realize the smooth diversion to the for-profit and non-profit transitions,and the key is to protect organizers'property rights according to the law.In the implementation of the classification management system,the government should objectively and fairly handle the property rights issue,kindly treat the property interests of the organizers,establish appropriate incentives for property preservation and appreciation,and improve the guarantee mechanism for property rights to protect the enthusiasm of the organizers.
