高校性骚扰投诉的处理机制与程序分析——以澳大利亚高校为例

摘　　要：本文主要基于澳大利亚高校反性骚扰的政策文本,总结和分析澳大利亚高校对性骚扰投诉的处理机制和处理程序,并阐释其制度设计背后的理念。在处理机制的建立上,澳大利亚多数高校将既有的通用投诉制度适用于性骚扰纠纷,体现出"最小改变"的制度变革特点。但也有部分高校选择制定专门政策、设立多元融合部门来处理性骚扰纠纷,这一方式代表了制度发展的趋势。在处理程序上,澳大利亚高校普遍建立起非正式和正式双渠道的性骚扰投诉程序。非正式投诉程序重在化解纠纷,为当事人提供支持和帮助;正式投诉程序重在查清事实,分清责任,需保障当事人的正当程序权利。文章最后为中国高校性骚扰投诉机制和程序的建立提出了一些建议和思路。Drawing upon university sexual harassment policies,this paper analyzes.Australian universities"systems and procedures for handling sexual harassment complaints and illuminates their underlying principles and functions."While most Australian universities adopt a minimum change approach by applying its general grievance procedures to sexual harassment complaints,some universities choose to issue policies specific on harassment and establish a diversity officer to handle the complaints,with the latter approach representing a growing trend.In general,Australian universities have two sets of procedures forhandling sexual harassment complaints:the informal channel an.d the formal channel.The purposes of the informal channel are to resolve the disputes through voluntary action or conciliation and to provide,continuous support to both parties.In comparison,the formal channel is used to make factual investigation and render sanctions,therefore necessitating a series of due process protection.The paper is concluded with a few recommendations on the establishment of sexual harassment handling systems and procedures in Chinese universities.
