摘 要:西方德性法理学的思想萌芽可以追溯至古希腊的亚里士多德的伦理学、政治学及其自然法本质的构想中。但是,当代西方的德性法理学作为一种规范和解释的法律理论,直接受到了当代西方德性伦理学复兴所提供的思想资源的启发。它融合德性伦理学、德性认识论和德性政治学,力图对当代法律理论的重大问题作出更深刻的回答,在亚洲、欧洲和北美引起了哲学和法学研究的关注。The governance of morality has become a very urgent practice in contemporary China.Scholars have focused on it for a long time and put forward a lot of methods in dealing with it.Virtue jurisprudence is one of the most famous legal theories in Western.It tries to give a more profound answer to the important problem in legal theory,such as the aim of law is not rights and welfare but civic virtue,and it thinks that a good judging must be virtuous.Virtue jurisprudence has developed a new perspective on the governance of morality,it has set up especially the virtuous criteria of good law and judge again which has been the tradition since Aristode in the West and since Confucius in China.Since law is a useful tool in the governance of morality,the most important thing need to be done is the virtuous turn of law itself.So virtue should not only become one aim of legislation,but also one standard of good judicatory.
