摘 要:中国《劳动合同法》的实施是劳动保护制度环境的发展,对员工参与公司利益分配产生了重要影响。以2004—2011年沪深两市上市公司为样本,实证研究了《劳动合同法》的实施对员工参与企业利益分配的影响。研究发现,《劳动合同法》的实施对员工参与企业利益分配具有积极作用;相对于国有上市公司而言,它对非国有上市公司员工参与企业利益分配的影响更大。该结论在一定程度上说明,《劳动合同法》的实施提升了企业利益分配格局的公平性和员工薪酬满意度,保护了劳动者的合法权益。The promulgation of The Labor Contract Law in our country is the development of the institutional environment on labor protection, having an important impact on employees participated in the benefits allocation of the enterprises. Using samples from 2004 to 2011, this study purposes to examine the impact of the law on employees participated in the benefits allocation of the enterprises. It finds that the promulgation of The Contract Law plays a positive role for employees to participate in enterprise profit distribution. It also finds that compared with the state-owned enterprises , the promulgation of the law have a greater impact on the employees participated in the benefits allocation in non-state-owned firms. This means that it improves the fairness of the enterprise profit distribution pattern and the compensation satisfaction. It also protects the lawful rights and interests of the labors in some ways.
