摘 要:业主大会会议往往通过书面征求意见的形式召开,对于已送达的征求表决票,业主若在规定的时间内不反馈意见,视为同意,此规定被称为"未投票视为有效同意"条款。实践中法院无一例外地支持此条款的效力,但该条款效力是存在问题的,其症结在于中国法律未提供业主大会会议无法决议时的解决办法。除完善业主大会会议的议事规则之外,要根本解决该条款所折射出的问题,需要进行良好的制度设计,建立业主代表制度,采用集体讨论、充分交换意见等方式,促进业主行使共同管理权。Condominium owners meeting is often held in the form of written vote inquiry. As for the delivered vote inquiry,in case that a condominium owner does not return the vote,he or she would be deemed as agreeing with the voting matters,and this is called'Non-vote Deemed as Consent'provision. The validity of such provision is doubted,but in practice,courts universally recognize it as valid. The problem lies in that the law does not provide resolution when condominium owners meeting could not reach agreement. Besides improvement of condominium owners meeting rules,in order to solve the underlying issue,it needs better mechanism design by establishing condominium owners representative system. Through collective discussion and sufficient exchange of opinions,the exercise of joint government by condominium owners would be facilitated.
