摘 要:基于教师聘任具有行政契约的性质,惩罚性解聘教师需要遵循行政制裁性解除合同的要求。现行法律制度下,惩罚性解聘教师存在解聘事由界定不清,程序缺失等方面的问题,这对学校行使教师管理权,教师维护自身合法权益带来重大影响。依据行政契约理论,进一步推进教师聘任制的实施,需要构建惩罚性解聘教师主体、事由、程序以及教师权利救济制度。To punitively dismiss a teacher should follow the requirement of dissolving the contract in administrative sanction, for appointment of a teacher is a kind of administrative contract. Under the current legal system, there are some existing problems such as the lack of procedure and no clear definition in reasons when dismissing a teacher, which has great impact on schools to exercise the right of teacher management and on teachers to protect their own lawful rights and interests. According to the theory of administrative contract, promoting the teacher appointment system needs to set up a punitive dismissing teacher relief system that includes the subject, reason, procedure and teachers' rights and interests.
