系统论视角下的食品安全法律治理研究

摘　　要：系统论提出之后在中国法学研究中得到有效运用,其理论对我国食品安全治理之完善有重要意义。从系统论的整体性分析,我国食品安全法律体系、食品安全监管体系和食品安全标准体系的整体性不强;从系统论的开放性分析,食品安全治理主体和食品安全信息的开放性不足;从系统论的动态性分析,食品安全的治理理念和治理方式不完善。为此,应扩大食品安全法的调整范围,提升食品安全法为基本法律,加快配套法规的立法进程,确立统一监管模式,强化和落实地方政府的食品安全监管责任,加强基层食品监管的能力建设,统一和提高食品安全标准,以增强食品安全治理的整体性;应培育食品行业协会,完善公众参与机制,加强食品安全教育,健全食品安全信息公布机制,以完善食品安全治理的开放性;应调整治理理念和治理方式,完善食品安全追溯系统以加强食品治理的动态性。System theory has been effectively applied in legal studies in China and it has great significance to improving the food safety management in china. In regard to the integrity of the theory, China has a weak legal system of food safety, the same as the food safety supervision system and the food safety standard system; In regard to the openness of the theory, china has a limitation in both the food safety governance subjects and the access to food safety information ; In regard to the dynamity of the theory, Chi- na is bleak in both its food safety philosophy and the management mode. Therefore, it is necessary to expand the food safety laws , with the Food Safety Law as the cornerstone and related regulations improved. It is necessary to unify the supervision mode, with the supervision responsibilities of the local governments and grass - roots supervision capacity strengthened. It is necessary to unify and improve the food safety standards to increase the overall food safety governance. It is necessary to fostering the food in- dustry associations and the mechanism of public participation. It is necessary to strengthen the food safety education and to im- prove the information disclosure mechanism to improve the openness of the food safety governance. It is also necessary to adjust the management philosophy and style, and improve the tracking system to strengthen the dynamity of the food governance.
