摘　　要：在哲学的语用学转向和非形式逻辑对话与论辩理论等理论的影响下,法律推理研究历经了一个由语形和语义研究到语用研究的转向。在具有强烈对话或论辩色彩的法律实践特别是司法实践中,法律推理研究的这种语用转向,为司法实践中之法律推理提供了新的分析评价视角,也为理性司法提供了更为恰当的逻辑理性根基。Being influenced by the pragmatic diversion of the philosophy, the dialogic and the argumentative theory in the informal logic, etc. , the legal reasoning has gone through the diversion from the syntactic and the semantic studying to the pragmatic studying. In the legal practice with strong argumentative tendency, the pragmatic diversion of the legal reasoning provides a new angle for the analyzing and evaluating to the legal reasoning, especially in the judicial practice. It also provides the foundation of the logical reason for the rational justice.
