摘 要:我国船舶保全的有关规定设立之初是为了满足海事诉讼的需要,并不能完全适用于仲裁程序。且仲裁程序下的船舶保全,因可能涉及国家间的司法协助及各个国家对仲裁与法院权力的不同分配而较之诉讼下的船舶保全更为复杂。我国《民事诉讼法》、《海事诉讼特别程序法》、《仲裁法》关于仲裁程序下船舶保全的规定并不完善且缺乏一定的合理性,可能会造成司法实践中的困难。在对有关困境进行深入探讨的基础上对相关法律修改提出合理化建议。As the purpose of the preservation of ships is to fulfill the demanding of maritime court proceedings, the provisions related don 't suit the arbitration proceedings properly. Difficulties may arise in judicial practice, for the provisions regarding the preservation of ships in arbitration stipulated in Civil Procedural Law of the PRC, Special Maritime limited and some discussion should Procedural Law of the PRC, Arbitration Law of them are not very reasonable.
