摘　　要：科学原理本身是不可专利的主题,应用了科学原理的发明才是可专利的主题。专利保护是一把双刃剑,因此应当恰当地划定科学原理和可专利主题之间的界限。Scientific principles are not patentable subject matters, but inventions which apply those scientific principles are may be patentable between scientific principles subject matters. The limits and patentable subject mat- ters should be appropriately drawn because the patent protection legal system is a sword with two blades.
