摘 要:法学界将迁徙自由作为一项基本人权予以关注。公民的迁徙自由权反映到教育领域的突出问题,就是对流动儿童初中后受教育权的保障。由于初中后教育连接高考,也是改变人生发展的重要契机,保障流动儿童初中后教育权要从实现社会善治、维护社会公正、促进社会发展的高度去认识和把握。本文基于迁徙自由的视角,分析了影响城市流动儿童初中后教育问题的现实安排与障碍,并在对流动儿童初中后教育问题进行深入思考的基础上提出政策建议。The freedom of migration is to be concerned as basic human rights in Jurisprudence. The outstanding problem that the migration freedom reflects to the field of education is the guarantee of migrant children's rights to education after junior high school. Since junior high school education is connected to the university entrance exam, and also an important opportunity of development, the guarantee of the migrant children's right to education after junior high school must be considered and grasped from social good governance, maintaining social justice, and promoting social development. In this paper, based on the perspective of migratory freedom, the writer analyzes the arrangement and obstacles which influence the urban migrant children after junior high school education, and puts forward policy recommendations based on in-depth thinking on issues of floating children after junior high school education.
