校企合作中退休返聘教师人身损害归责及赔偿项目实务解析

摘　　要：无论是学校类的事业单位法人还是校企合作成立的企业法人均可能聘用业已达到退休年龄的人员,校企合作单位聘用具有一定专业技能的退休教师也逐渐成为常态。退休返聘的教师受伤后并不能依据工伤保险条例进行工伤索赔,双方之间的关系是劳务关系,需依据过错责任原则来判定双方的责任及赔偿数额。Whether the non -proofit organizations such as school or the enterprises established by coopera- tion between company and school, they may employ staff over the retirement age. School - enterprise coopera- tion units employ retired teachers who have certain professional skills. , which gradually become the norm. The retired teachers who are hurt can＇ t claim on the basis of industrial injury insurance regulations, for the reason that they are not in labor legal relationship but of fault liability to determine responsibility and in the employment relationship. It must be based on the principle damages on both sides.
