摘　　要：我国未决羁押人员为数众多,鉴于未决羁押的特殊性及法律法规的滞后性,为解决该群体社会保障存在的若干问题,课题组对四川省Z市、Y市的未决羁押人员展开了调研,在对调研数据进行实证分析的基础上,指出未决羁押人员及其近亲属在社会保险、社会福利、社会救助等方面面临的问题、诉求表达途径及现行相关法律法规的缺陷。借鉴国内外立法例并结合我国实际,试从完善法律建设及诉求回应制度、重视社会救助、试行羁押外工作制、羁押社会化等方面提出对策,以期为我国《刑事诉讼法》的修订、《社会保障法》的出台提供参考。There are a large number of persons serving pending custody in China. In view of the particularity of Pending Custody and the under - developed situation of laws, the team has carried out research on the persons serving pending custody in Z and Y city in Sichuan province, so as to resolve the Social Security problems of these people. Based on the empirical study and analysis of the data, this thesis points out the problems confronted by persons serving pending custody and their close relatives in social insurance, social welfare and social relief, the ways they resort to and the flaws in current laws and regulations. Then it draws lessons from the legislation examples abroad, combines them with the reality of China and puts forward countermeasures from the following aspects： perfecting the legislation and responding system of requests, attaching importance to social relief, practicing work rules out of custody and socializing custody so as to offer some reference for the amendment of Criminal Procedure Law and the Legislation of Social Security Law.
