摘  要:2012年3月教育部副部长杜玉波在"全面提高高等教育质量工作会议上的讲话"中明确指出"要把教学内容、教学方法、教学模式改革作为高等教育教学和人才培养的最基础性工作,大力推进启发式、探究式、讨论式、参与式教学,加强师生互动。"研讨式教学法的代表是"席明纳"教学法。"席明纳"教学模式源于德国,19世纪后成为西方现代大学教学方法的重要支柱之一,重在训练高校学生的开放自由的学术思辨能力。我国高校法学学科应通过增设"席明纳"研讨课程,积极进行教学改革尝试,使高校法科学生在教师的引导下,通过自主研究与集体讨论,进行知识构建,体验法学研究方法,进而充分培养其分析问题、研究问题、解决问题的能力,实现法学人才培养模式的改革实践目标。In March 2012, Du Yubo, Deputy Minister of Ministry of Education, in the "speech for the conference on comprehen-sively improving higher education quality", clearly stated that"we should take the teaching content, teaching methods and teaching mode reform as the most basic work of higher education and per-sonnel training, vigorously promote heuristic, inquiry-based, dis-cussion-based and participatory teaching, and strengthen teach-er-student interaction". The representative of discussion-based teaching method is"Seminar"teaching method which originated from Germany and has become one of the important pillars of Western modern university teaching methods after the 19th centu-ry. It aims to train university students' open and free academic critical thinking ability. In the law discipline of China's universi-ties, the "Seminar" discussion course should be added to the teaching reform, in order to make university law majors construct their knowledge and experience law research methods through autonomous research and group discussion under the guidance of teachers, thus fully cultivating their abilities of analyzing, re-searching and solving problems, and realizing the goal of reform-ing and practicing law talent cultivation mode.
