摘 要:历史和实践表明,欧洲法院的判例对于高等教育一体化的发展提供了法理依据和法律保障。然而在此过程中,欧洲法院以司法积极主义方式推进高等教育一体化,从而对成员国教育系统的干预和影响也引发成员国的批评。对此,欧盟试图在教育政策的行为方式上做出调整,其中一个重大变化就是在立法活动上发生了从欧洲法院的到部长理事会的转变,欧洲法院所发挥的更多的是常规的解释性而非立法的作用。而从未来发展来看,在高等教育领域,欧洲法院对欧盟法的解释仍将对界定成员国与欧盟机构界限发挥重要作用。From the historical and practical perspectives, the decisions made by ECJ in related cases provid- ed legal basis and support to the development of European higher education integration. However, ECJ's interven- tion and influence with the approach of juridical activism to the education systems is also criticized by the member states. As an attempt to avoid this conflict, a major shift in the Council of Ministers has been made. And the ECJ is p emphasis of the law-making activities from the ECJ to laying a more conventionally interpretative, rather than !awmaking, role in relation to the development of education law. In the long run, the ECJ's interpretation of European Law will remain important in demarcating the boundary between national and European authority in higher education.
