摘 要:抵押权的实现是抵押权制度的核心内容。抵押权实现的方式,应依《担保法》的规定,并结合实际情况,采取折价或拍卖、变卖方式。房地产法限制房地产抵押权的实现仅以拍卖方式,不利于抵押权人权益的实现。在一物上数个抵押权并存时,其受偿顺序应采取顺序固定主义;一般抵押权与法定抵押权并存时,法定抵押权应优先于一般抵押权获得受偿。The realization of hypotheca is the core content of hypothecation system.According to the regulation of the Mortgage Law and the demand of certain situation,to realize hypothecation should take the way of converting into money,auction,selling off etc.The Real Estate Law limits the realization of hypothecation to the only way of auction,and this regulation hampers the realization of hypothecation.If there are several hypothecation of one thing,the sequence of payment should be fixed.When common hypothecation and statutory hypothecation coexist the payment of statutory hypothecation should prior to that of common hypothecation.
