理论与实践视域中高校学士学位权的法理分析

摘  要:学位授予权是国家或国家授权的教育机构对具备一定受教育程度和学术水平的个人授予相应学位并颁发相应学位证书的法定权力。从法理层面来讲,享有学位授予权的高校是法律法规授权的行政组织,学位授予行为既是一种自由裁量行政行为,也是一种依申请行政行为,具有可诉性。但目前高校学士学位授予权的行使,存在学士学位授予缺乏可操作性标准、高校学士学位授予条件自我扩大了法律法规授权的边界、学士学位授予管理制度不完善等法律缺失现象。高校学士学位授予权的合法行使,必须从建立大学学位制度、完善学士学位授予标准、加强学士学位授予的法律意识、强化学士学位授予管理等方面着手。From the legal principle, the colleges and universities that are entitled to the Right of Degree-conferring are the administrative organizations authorized by laws and regulations. The behavior of accrediting degree is a kind of administrative act of discretion, and also a sort of administrative act of application according to the law. It has justiciability. Anyhow, the performance of the Right of Bachelor' s Degree-conferring exists problems of legal-deficiency, such as lacking operational standards, expanding boundary regulated by the laws and regulations, and having imperfection of management system. The legal performance of the Right of Bachelor' s Degree -conferring should be based on building the college academic degree system, perfecting the criteria, strengthening the legal consciousness and intensifying management.
