摘 要:中国农村土地市场化和货币化的最大阻力是农地产权问题。农地产权问题主要有农地所有权残缺、土地财产权含糊不清、农地剩余索取权被低估、农地产权货币化交易困难等。解决这一问题的关键是农地产权的契约化,包括权利内容契约化、收益契约化和风险契约化。为此,可以借鉴日本农地契约化运行模式,构建中国特色的四层级的农地契约化运行模式和运行机制。It is the biggest obstacle to do the market-oriented and monetization on the property rights of the rural land in China, which is mainly lacked of the market mechanism of the property right of disposition, the market environment and the monetary currency transactions. The key to solve the problem is the socialization and the contractization of the property rights,which includes the right content contract, the revenue contract and risk contract. Finally, referring to the experience of Japanese land contract operation mode, build four-levels operation mode and the corresponding operation mechanism on the rural land contract.
