摘 要:近年来,社会保险欺诈日趋复杂化与专业化,欺诈手段日益向隐蔽化和多样化方向发展。社会保险欺诈的严重危害决定了及时发现和事前预防的重要性。现行的社会保险反欺诈立法主要侧重于事后的责任惩处,缺少能够提高社会保险反欺诈的积极性和主观能动性的激励机制。在激励理论视角下,社会保险反欺诈的机制建设应更多关注激励主体、激励资源、激励依据以及激励实施等要素,采取物质激励与精神激励相结合的激励方法,注重多种手段与策略并举,适时调整激励与约束机制的搭配比重,并逐步实现社会保险反欺诈激励机制的规范化和制度化。In recent years,the social insurance fraud has become complicated and specialized,and the fraudulent means present concealment and diversification increasingly. The serious damage of social insurance fraud determines the importance of timely detecting and beforehand preventing. The current social insurance anti- fraud legislation puts particular emphasis on expost facto punishment,and lacks the incentive mechanism which can boost the enthusiasm of the social insurance fraud and subjective initiative. The mechanism construction of social insurance anti- fraud should pay more attention to the incentive subjects,incentive resources,incentive basis and incentive method from the perspective of the Motivation Theory. We should adopt the means which combine the incentive material with spirit incentive,develop various means and strategies simultaneously,adjust the proportion of the collocation of incentive and constraint mechanism timely,and gradually achieve the standardization and institutionalization of the incentive mechanism of social insurance fraud.
