摘 要:新的历史发展时期和法律环境下,劳务派遣同工同酬问题依然是重大的社会课题之一。《劳动合同法》的实施并未为劳务派遣同工同酬问题提供实际可操作性的规则指示,同工同酬的认定标准依然混乱,劳动者负有举证苛责,相关法律救济不足。域外界定同工同酬的标准、举证制度的安排及救济程序为完善我国劳务派遣同工同酬提供借鉴。对此,应当重新界定、理解"同工"、"同酬"及豁免的正当事由,对当事人举证责任内容作出衡平规定并且完善同工同酬救济程序,引入集体劳动争议诉讼程序设计,从而完善劳务派遣同工同酬的司法适用。Under the new historical period of development and legal environment, the labor dispatch is still one of the major social issues. The implementation of the labor contract law did not provide practical rules for labor dispatch problem of equal pay for equal work. Standard of equal pay for equal work is still in chaos, the burden of proof is heavy, and the related legal relief is insufficient. Other countries' practices related the definition of equal pay for equal work, proof arrangement and remedy procedure has provided us with reference. We should redefinition the standard of equal pay for equal work and exemption from the subject , define contents of proof of the parties and promote the relief procedure with refer to the collective labor dispute proceedings in order to improve the application of labor dispatch of equal pay for equal work for justice.
