基于“工学结合”的高职生顶岗实习意外伤害及其解决机制

摘　　要：在"校企合作、工学结合"的高职人才培养模式下,高职生在顶岗实习期间发生的意外伤害,在现行法律框架下可通过签订实习协议、购买商业保险和民事侵权制度加以解决,但学生的权益并不能得到及时、有效的救济。应通过充分发挥政府的主导作用,完善相关法律法规,加强监管,构建多重保险体系来对学生顶岗实习期间的权益加以有效保障。In the higher vocational personnel training of the mode of Cooperation Between Schools and Enterprises and Combination of Learning and Working,higher vocational students may be injured unintentionally during their post practice. The problems of unintentional injuries can be solved with the sign of internship contracts,the purchase of business insurances and the civil tort system by laws,but timely and effectively. Students＇ rights and interests in their post practice should be guaranteed by the leading role of the government,the improvement of relevant laws and regulations,the enhancement of governmental supervision and the establishment of a multiple- insurance system.
