摘 要:就业歧视问题是一个普遍性的、长期存在的世界性难题,不同国家和地区不同程度地存在着就业歧视现象。就业问题是民生大计,关系到我国社会发展一系列重大问题。就业歧视问题也牵涉到我国法律对公民的公平对待、平等保护等问题。当今我国社会就业歧视现象严重,各种就业歧视日益复杂地凸显出来,而法律规定相对原则化和滞后,缺乏确定的就业歧视的适用标准,导致无法在司法实践中做到准确地法律适用。通过对各种就业歧视现象和相关法律规定的分析,认为有必要对现有法律进行修改和完善,制定更为具体、有效的就业歧视司法认定标准。The problem of employment discrimination is a universal, a world difficult problem for a long time, and there are varying degrees of employment discrimination in different countries or regions. The employment problem is related to people's livelihood and a series of major problems in social development of our country. The problem of employment discrimination also involves China's laws on fair treatment and equal protection of citizens. At present, there is serious employment discrimination in our society and this problem is increasingly complex, while the laws relatively lag behind and are lack of employment dis- crimination applicable standards, which has resulted in inaccurate legal application in judicial practice. Therefore, based on the existing employment discrimination in society and analysis of relevant laws and regulations, it is necessary to revise and improve the existing laws, and develop more specific and effective judicial identification standards of employment discrimination.
