完善对国有资产监督管理机构的监管研究

摘　　要：由于《企业国有资产监督管理暂行条例》规定国有资产监督管理机构为政府直属特设机构,或由于各级政府忽视对国有资产监督管理机构的监管,使国有资产监督管理机构处于无人监管的状态,引致其违法违规地进行国有资产监管,并造成不良的社会影响。本文分析了对国有资产监督管理机构监管存在的问题及其原因,并在此基础上提出了完善对国有资产监督管理机构监管的对策建议,即完善监管原则、确定"微观"监管执行主体和确定国有资产监督管理机构的单一"身份"。Due to the provisional regulations on the supervision and administration of state-owned assets of enterprises provided that the state-owned assets supervision and administration institution was the ad hoc institutions directly under the government, or because of all the government neglecting the supervision of the state-owned assets supervision and administration institution, which made the state-owned assets supervision and administration institution sinking in unsupervised state, and resulting in the state owned assets in our country being supervised illegally, to bring about undesirable social influence as well. This paper analyzes on the problems and their causes existing in the state-owned assets supervision and the supervision and on this basis to proposed the countermeasures and suggestions on how to improve the supervision of the state- owned assets supervision and administration institution, so that it will improve the supervision principle, determined the ＂micro＂ executive subject and unique ＂identity＂ of the state-owned assets supervision and administration institution.
