高校教育管理权和大学生隐私权的冲突与协调

摘　　要：随着依法治国的全面推进,依法治校也迫在眉睫,然而高校中一直存在着侵权现象,也存在因过度维权导致高校教育管理陷入困境的情况。学校的依法治校意识还比较薄弱;依法治校的法律制度和学校规章措施还不健全,其中高校在教育管理过程中与大学生隐私权产生了冲突,造成了大学生隐私权被侵犯,故而可就此设计协调高校教育管理权和大学生隐私权的相关措施。两种权利的协调原则主要为利益衡量原则,协调的依据为法律规范和高校规章制度的建设,协调的实现靠法律意识和职业道德的提高,以期建立高校与大学生的和谐发展关系。With the overall promotion of the rule of law, managing the university according to law is imminent. However, some universities face the phenomenon of infringement, or a plight of management caused by excessive rights protection. The law governance awareness is relatively weak; the legal system of governing the school by law and the school rules and measures are still not perfect. There is a conflict between educational administration right and university students＇ right of privacy, resulting in the invasion of privacy of students, and insufficient teaching management in universities. Therefore, this paper focused on the conflict between educational administration right and university students＇ right of privacy, and the coordination measures related to the right, in order to establish the harmonious development relationship between the universities and students.
