中外合作大学是不是第三种高校类型?——兼与刘梦今商榷

摘　　要：中外合作大学的公私属性问题始终是中外合作大学研究中最重要和最基本的理论问题,因为它直接关系到中外合作大学的权利和义务,并影响到中外合作大学的发展方向。目前,学术界关于中外合作大学公私属性的认知存在着模糊不清的现象,政策失真、研究者的思维惯习和利益相关者的理论博弈是造成中外合作大学属性模糊的重要原因。我们认为中外合作大学具有或公或私的属性,而没有"非公非私、亦公亦私"的第三条道路可走。区分公私两种属性的中外合作大学,有助于探讨各自的权利与义务,以促使中外合作大学健康、可持续发展。Are Sino-foreign universities public institutions or private ones? This is a question that would define the fundamental rights and duties of Sino-foreign universities,and directly affect their development in the future as well. At present,people seem to have rather ambiguous ideas about the nature of Sino-foreign universities,due to researchers' fixed mindset,distortion in implementing public policies,and conflicts of interest between different stakeholders. Mr. Liu Mengjin hold that Sino-foreign universities belong to a third type of higher education institutions,which could have mixed public-private nature,or neither public nor private. However,in our opinion,Sino-foreign universities should be either public or private,and there is no other alternative. Clarifying the public-private nature of Sino-foreign universities could help us better understand their rights and duties and promote the healthy and sustainable development of Sino-foreign universities.
