非法口供排除中的若干疑难问题及其破解

摘　　要：如果当事人申请排除口供,而法庭未启动排除程序,或者启动后决定不排除口供,在口供的证明力审查阶段,当事人仍有权再次提出申请排除的理由,对口供的证明力进行质疑。对于口供的排除与证言、被害人陈述的排除,在取证违法程度上应采取相同的判断标准,即违法取证行为是否迫使当事人违背意愿进行陈述,而不应对口供要求更严重的取证违法程度。检察机关在审查起诉阶段排除口供后如果重新取证,必须采取措施保障嫌疑人能够作出任意性陈述,否则所取口供依然要被排除。对于被排除的反复自白中有利于被告人的证据信息,法官不能忽视,必须进行调查核实。供述笔录在证明口供取证合法性方面只能发挥极其有限的作用,必须有其它补强证据对其进行补强且供述笔录前后一致不能作为取证合法性的根据。在多个被告人的案件中,无论被告人的口供是否不利于其他被告人,其他被告人都有权申请排除该口供。If parties apply for excluding illegal confession while the j udge hasn’t started the exclusion procedure yet,or has decided not to exclude the confession,parties still have the right to put forward causes for application to refute the probative force.The standard of excluding con-fession,testimony and victim statement should be the same one,that is,whether the illegal act of collecting evidences makes people confess against their free will.If procuratorial organs exclude confession in the process of review of the indictment and interrogate suspects again,they must ensure suspects make voluntary confession.Judges mustn’t ignore the information beneficial to the accused in the excluded repeated confession.Confession notes have little value in proving the legality of collecting evidences,and the accordance of confession notes can’t be the indication of legality.In cases with many defendants,each defendant has the right to apply for excluding other defendant’s confession no matter that confession is against him or not.
