青海省实施主体功能区规划的环境法律制度思考

摘　　要：主体功能区规划是优化国土空间开发格局,促进区域协调发展的重大战略决策。规划的落实需要相应的制度保障,而法律制度是最为重要的方面。本文试图通过青海主体功能区规划的发展定位,对规划落实所面临的环境困境进行分析,以环境法与功能区制度所追求目标的共同性角度,对主体功能区规划落实的环境法路径进行了分析和思考,以期对今后开展进一步研究提供一定的思路。The plan on main functional zones is a significant strategy policy to optimize the development patterns in relation to the spatial of national land and to promote balanced development among regions.Accordingly,the implementation of the plan demands a system guarantee in which legal system plays the most important role.This article tries,through positioning the development plan of the main functional zone in Qinghai,to analyze the environmental plight with which the implementation of this plan is faced.Besides,from the perspective of the common purposes pursued both by environmental law and the system concerning functional zones,the author analyzes and contemplates the environmental law path on the implementation of main functional zone plan for further research on this respect.
