依法治教视野中的教授治学

摘　　要：大学内部治理是"学术为根本"、"法治为保障"的治理,这是由大学的本质属性和治理的基本要求所决定的。在我国大学内部治理中,"学术为根本"的实现依赖于"教授治学"的发展,"法治为保障"的确立离不开"依法治校"的驱动。教授治学只有在法治的保障下才能真正实现,依法治校只有彰显大学的学术性本质才具有实质意义。依法治校与教授治学相向而行是大学内部治理创新的中国进路。The internal governance of the university is based on academics and rules, which is determined by the nature of the university and the basic requirement of governance. In Chinese universities, the realization of academic orientation depends on professors＇ academic governance, and the establishment of rules as the guarantee depends on university governance by law. The realization of professors＇ academic governance needs the safeguard of university governance by law. University governance by law will have no real significance unless it is based on manifesting the academic nature of the university. The internal governance innovation of the university in China will need university governance by law and professors＇ academic governance running cooperatively.
