摘  要:房地一体原则并不理所当然地适用于所有的土地使用权与建筑物所有权的关系,我国法律亦未确认宅基地使用权与建筑物所有权之间一并处分的原则。故宅基地使用权无法通过继承方式取得,继承人因继承房屋等建筑物所有权占有、使用宅基地但却不享有宅基地使用权,致使宅基地使用权主体(即农村集体经济组织,此时宅基地所有权、使用权主体合二为一)与房屋所有权主体相分离。换言之,继承人占有、使用宅基地丧失了法律正当性,为调和宅基地使用权人与继承人之间的利益关系,以宅基地"法定租赁权"为解释路径为继承人占有、使用宅基地提供法律正当性依据,无疑是更优的选择。Principle of integration between ownership of building and h not of course applies to all relationships between the land omestead rights which is rights and ownership of buildings, and our country law has not confirmed the principle between homestead rights and ownership of building . Therefore, the homestead cannot be acquired through inheritance, and heir to the ownership of building possession and use homestead land while not enjoying homestead rights, which makes the subject of homestead rights ( namely the rural collective economic organization, the ownership of the land and the subject of homestead right become one at this time) different from the ownership of building. In other words, the heir to the possession and use of the land lost legal justification, in order to reconcile the interests between the land owner and the heir, using "statutory lease" as a explaining path for the heir to possession and use homestead land to provide legal legitimacy basis, undoubtedly is a better choice.
