摘 要:2014年,党的十八届四中全会决定明确提出编纂民法典,目前民法总则制定已列入十二届全国人大常委会立法工作计划,民法典进入实质性编纂阶段。民法典编纂应如何回应现实关切,使市场经济下的雇佣合同与劳动合同关系规范化与体系化,是民法典编纂面临的主要挑战之一。基于我国雇佣合同与劳动合同的现实分析,在研究德国与意大利民法典关于雇佣合同与劳动合同立法实践的基础上,提出我国民法典编纂应在民法典总则中增加与人身有关的法律行为制度;在总则之下的合同编,增加雇佣合同为《合同法》之有名合同的一种类型,同时将劳动合同制度作为雇佣合同制度的特殊规则,使其具有民法契约法基础,由此使雇佣合同和劳动合同关系规范化和体系化。In 2014, the Fourth Plenary Session of the 18^th CPC Central Committee decided to start the codification of Chinese Civil Law, and included making the General Provisions in the legislative work plan of the 12th NPC Standing Committee; these indicate codification of Chinese Civil Law enters into a substantive stage. How to respond to practical concerns for legalization and systematization of employment contract and labor contract relations is a major challenge. This paper suggests, based on an analysis of Chinese employment contract and labor contract relations and on a study of German and Italian civil law codes, that the codification of Chinese civil law should respond to practical concerns for legalization and systematization of employment contract and labor contract relations, to establish personality juristic act system in General Provisions, and to introduce employment contract into " Contract Law", with labor contract as its special rules, thus giving effect to legalization and systematization of employment contract and labor contract relations.
