儿童权利保护的困境与对策——基于幼儿园“虐童事件”的思考

摘  要:近年来,幼儿园“虐童事件”的频频发生,已引起了社会各界的广泛关注。文章阐述了虐童的含义与危害,依据儿童权利的主要内容对“虐童事件”进行申诉,以及幼儿园儿童权利保护中的实践困境;最后通过对国外儿童权益保障的立法以及制度的借鉴,实现“儿童权利”从伦理意义向法权意义上的转变;加强幼儿教师专业伦理教育三个方面提出保护儿童权利,预防“虐童事件”再次发生的建议。In recent years, child abuse cases in kindergarten frequently happened which have caused widespread concern in the society. This paper expound the meaning and harmness of child abuse, appeal child abuse on the basis of the main content of children's rights, practice predicament in kindergarten children's rights protection, Finaly, reference the pretection of children's rights legislation and system in foreign country to achieve the rights of children divert ethical meaning to the sense of law rights. To strengthen the professional ethics education of preschool teachers, three aspects are put forward to protect children's rights and prevent the occurrence of child abuse.
