摘  要:实践教学中的模拟法庭活动目前存在课程和竞赛两种模式,其中竞赛在发挥正面功能性引导价值的同时,也面临着与理论教学计划的冲突问题。在指导和应对比赛的过程中,很多高校面临参与者积极性不高、备赛时间不足、参赛队员集中训练影响正常教学等诸多困境。可通过开设模拟法庭竞赛理论与实训课程,将其纳入教学计划而起到化解上述冲突的作用:在规范参赛活动的同时,也能调动指导教师和学生的积极性,有利于参赛队伍的建设。As an important link in practical teaching, there are two modes in moot court at present, i.e course and competition. Moot court competition plays a positive functional guide value, meanwhile it also faces the conflict with theoretical teaching plan. Many colleges and universities face a lot of difficulties in the process of guiding and coping with the competition, such as the participants" low enthusiasm, lack of preparation time, the effect of team members" concentrated training on the normal teaching and so on. And the abovementioned problems could be solved by opening courses of moot court competition theory and practice and taking it into teaching plan, which can guarantee the standardization of entry activities, arouse the enthusiasm of teachers and students, and help construct the participating teams as well.
