观念与现实:西方康复权对我国康复服务进医保的启示与思考

摘　　要：康复权是《残疾人权利公约》和我国《残疾人保障法》规定的残疾人基本权利之一,其实现与一个国家的社会政策和法律制度的建设密切相关。康复权的实现在西方国家历经了一个漫长的追索过程,随着我国经济条件的改善,将残疾人康复服务纳入社会保障的基本范畴成为一种趋势,主要体现为康复服务进医保。但是,我国目前纳入医保的主要是9项医疗康复项目,尚不能完全满足康复需求。在现有基础上,扩大康复服务进医保的范围,加大制度建设,促进立法保障,是促进残疾人康复权全面实现的基本路径。The rehabilitation fight is one of the basic rights of persons with disabilities regulated by The Convention of the Rights of Persons With Disabilities and Law on the Protection of Disabled Persons of Peoples Republic of China. Its realization is closely related to the construction of social policies and legal systems of a country. The realization of the rehabilitation right in the Western countries has experienced a long recourse process. With the improvement of China＇s economic conditions, it has become a trend to bring rehabilitation services of disabled persons into the basic categories of social security, which mainly reflects in that the rehabilitation services has been brought into health insurance. However, what currently included in Chinese health insurance are mainly nine medical rehabilitation projects, which still can＇t fully meet the needs of rehabilitation. On the existing basis, to expand the scope of rehabilitation services which are brought into medical insurance, increasee the system construction and promotee the protection of legislation is the basic way to promote the comprehensive realization of the rehabilitation right of disabled persons.
