摘  要:职业教育"产学合作",过去主要研究的是其合作模式和合作的方法,这些模式主要停留在经验层面的探索上。随着"产学合作"向持久和深度融合发展,迫切需要国家层面的法律制度建立,从法律上保障"产学合作"各方的职责、义务和规范各自的行为。本文通过对我国职业教育"产学合作"发展模式的现状回顾,借鉴国外发达国家在"产学合作"上走过的历程,分析国家制度建立的法律规范功能,提出建立国家、地方及产学指导机构的多级"产学合作"管理制度的设想,并通过建立中介机构和遴选"产学合作"评价指标来监督和保证"产学合作"的实施。The cooperation between enterprises and vocational colleges in Vocational education was mainly the study of its cooperation model and cooperation methods in the past. These models and methods mainly stayed in the experience level of exploration. With the development of production and learning cooperation to the depth and the depth of the development, the urgent need for the establishment of the legal system at the national level, from the law to protect the "production and learning cooperation", the parties responsibilities, obligations and norms of their own behavior. Through the review of China's occupation education status of "cooperative" mode of development, from the process of foreign developed countries in the "cooperative education", analysis of national laws and regulations on establishment of the system function, proposed by the state, local and industry guidance institutions "multi-level cooperation of production and learning management system. And through the establishment of intermediary institutions and the selection of evaluation index of industry cooperation" to supervise and ensure the implementation of the "cooperative education".
